Freedom of Information Act

The Freedom of Information Act (FOIA) requires public bodies to operate openly and provide public records, upon request, as expediently and efficiently as possible. As a district hospital, Jersey Community Hospital must comply with the (FOIA). (Please note: Patient medical records are covered separately through HIPPA.)

How may the public request information and public records?

Requests for public information shall be submitted to the following individual serving as the Hospital’s Freedom of Information (FOI) Officer:

Process for submitting a Freedom of Information request:

1. FORM OF FOI REQUESTS

Requests for information shall be in writing and shall identify the requester by name, address, and organization, if applicable. The request shall identify the information requested as specifically as possible. The request shall specify whether the request is for the inspection and photocopying of the information or for the photocopies of the information only. If certified copies are required, the request shall so state. The requester is asked to provide a telephone number in order for the FOI officer to clarify any requests or set up times for an inspection of records.

2. RESPONSE TO FOI REQUESTS

The FOI officer or designee shall act upon requests. The requester shall be notified in writing or electronic mail that the request has been approved, denied, or extended pursuant to the Freedom of Information Act. The approval of a request for inspection shall identify the documents determined to be in response to the request. If the information requested is stored as computer data and not available in a comprehensible printed form, the approval shall identify the data, the actual cost of providing a comprehensible printed form and the amount of time necessary to provide the requester with the printed form. The approval of a request for photocopies shall identify the documents, the exact number of pages and the fee for photocopying, postage, and certification, if certified copies are requested. A copy of each denial and an affidavit of mailing of the denial shall be on file at the office to which the request was made.

3. TIME AND PLACE OF ACCESS FOR RECORDS

The approval of a request for inspection shall inform the requester where the information will be available for inspection. The approval of a request for photocopies or computer-stored data will inform the requester that upon receipt of the appropriate fee the material will be mailed or available for pick-up at a specific place.

4. FEES AND COSTS FOR FOI REQUESTS

There is no charge for providing up to 50 black and white photocopies. There will be a fifteen cents per page fee after the first 50 pages. The charge for in-house color copies shall be $0.25 per copy. Information supplied in electronic format documentation is limited to the cost of the electronic storage device (cd or disc). The cost for certifying record copies shall be $1.00.

5. APPEAL OF A DENIAL OF An FOI REQUEST

Requests for information shall be reviewed and responses made within 5 to 10 working days. If the information requested is exempt under the FOIA, a notice of denial shall be provided.

Denials of requests for records must be made in writing and justify the specific reasons for nondisclosure under the Freedom of Information Act. An appeal of the denial may be filed by the requester with the Public Access Counselor, in the Illinois Attorney General’s Office, 500 S. 2nd Street, Springfield, IL 62706; telephone 217-558-0846; publicaccess@atg.state.il.us.
